3. Eligibility

You must be at least 13 years of age to use this Site and our services. By using the Site, you represent and warrant that you meet this age requirement. If you are under 18, you confirm that you have obtained parental or guardian consent to use the Site.

For institutional or organizational clients, you represent that you have the authority to enter into agreements on behalf of your organization.

• All work is subject to agreed timelines and milestone reviews

4.4 Speakers and Sessions

For speaking engagements and educational sessions:

• Cancellations or rescheduling must follow the terms in separate agreements
• Recording and distribution rights will be specified in engagement contracts

5. Products

5.1 HaxRefs - Job Referral Platform

When using HaxRefs:

• You agree to provide accurate professional information
• Your profile may be shared with potential employers and referrers (with your consent)
• We facilitate connections but do not guarantee job placements or referrals
• You are responsible for your interactions with other platform users
• AI-powered matching is provided on a best-effort basis

5.2 CTF Platform

When using our CTF Platform:

• You agree to engage in fair and ethical participation
• No cheating, sharing solutions during active competitions, or unfair advantages
• Platform infrastructure and other users' accounts must not be targeted
• Skills learned should only be applied in authorized, legal contexts

6. User Accounts

6.1 Account Creation

To access certain services and products, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information promptly
• Maintain the security of your password and account
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

6.2 Account Restrictions

Users may not create multiple accounts without authorization. Account sharing is prohibited. Accounts used for fraudulent purposes or abuse will be terminated immediately.

7. Project Haxnation - Open Source Community

Project Haxnation is our community-driven initiative for open-source CTF challenges:

• All challenges are released under the GNU GPL license
• Contributors grant rights according to GPL terms
• Users may use, modify, and distribute challenges per GPL requirements
• Attribution and license compliance are required
• We maintain the right to moderate and curate contributed content

8. Payment Terms

8.1 Service Fees

For professional services (custom CTF development, curriculum design, speaking engagements):

• Fees will be outlined in service agreements or proposals
• Payment terms (deposits, milestones, final payment) will be specified
• Late payments may incur fees or service suspension
• All fees are in the currency specified in the agreement

8.2 Product Subscriptions

For digital products and subscriptions:

• Pricing is displayed on the Site and may change for new purchases
• Recurring subscriptions bill automatically until cancelled
• Payment must be provided through approved payment methods
• You are responsible for applicable taxes

9. Intellectual Property Rights

9.1 Haxnation Content

The Site, our services, and all associated content, features, and functionality are owned by Haxnation and protected by international copyright, trademark, and other intellectual property laws.

9.2 Custom Work Product

For commissioned work (custom CTF challenges, curriculum design):

• Intellectual property ownership will be specified in service contracts
• We may retain portfolio rights to showcase our work (with anonymization if requested)
• Clients receive rights as specified in their service agreements

9.3 User Content

You retain ownership of content you submit (resumes, profiles, forum posts). By submitting content, you grant us a license to use, display, and process it for providing our services.

9.4 Open Source Content

Project Haxnation challenges are licensed under GNU GPL. By contributing, you agree to license your contributions under the same terms.

10. Acceptable Use Policy

You agree NOT to:

• Use our services for any illegal purpose or in violation of any laws
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the integrity or performance of our services
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Impersonate others or misrepresent your affiliation

• Use our services to compete with Haxnation
• Reverse engineer our proprietary technology

11. Educational Purpose and Ethical Use

Haxnation provides cybersecurity education in a legal and ethical environment. Skills learned through our services should only be applied:

• Within authorized systems and environments
• With proper legal authorization and permission
• In compliance with all applicable laws and regulations
• For defensive and constructive purposes

Unauthorized access to computer systems is illegal. Users are solely responsible for ensuring their activities comply with applicable laws.

12. Confidentiality

For clients engaging our professional services:

• We treat client information and project details as confidential
• Specific confidentiality terms may be outlined in service agreements or NDAs
• We will not disclose client information without authorization
• Clients must similarly protect any confidential Haxnation information shared

13. Service Modifications and Availability

We reserve the right to:

15. Disclaimer of Warranties

Our services are provided "AS IS" and "AS AVAILABLE." Haxnation makes no warranties, expressed or implied, regarding:

• That services will be uninterrupted, secure, or error-free
• The results or outcomes from using our services
• Job placement or career advancement (for HaxRefs users)
• Skill development outcomes (for educational services)

16. Limitation of Liability

To the maximum extent permitted by law, Haxnation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, use, or opportunity
• Business interruption
• Failure to secure employment or referrals
• Costs of obtaining substitute services

Our total liability for any claim shall not exceed the amount paid by you to Haxnation in the 12 months preceding the claim.

17. Indemnification

You agree to defend, indemnify, and hold harmless Haxnation from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your misuse of our services or products
• Your violation of any laws or third-party rights
• Your unauthorized application of skills learned through our services
